Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and Malientu Media LLC, a California limited liability company with its principal place of business at 225 S Lake Avenue, Suite 300, Pasadena, CA 91101 ("Malientu", "we" or "us"). They govern your access to and use of the website at malientu.com, our mobile app and related services (the "Service"). Please read them carefully. By creating an account or using the Service you agree to be bound by these Terms and by our Privacy Policy.
About the Service
Malientu is a free, non-commercial archive for analog-era moving image. Watching content on Malientu is free and does not require payment, a paid subscription, a revenue-share scheme or any other monetary reward. Malientu does not offer trading, investment, cashback, affiliate earnings or similar features. Contributors who submit tapes receive no monetary compensation and retain their rights in the underlying work; a preservation licence is granted as described below.
Eligibility
You may use the Service only if you are at least 13 years old (16 in the European Economic Area or the United Kingdom) and capable of forming a legally binding contract. If you use the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information, to keep it up to date and to notify us immediately at security@malientu.com if you suspect unauthorised access.
Acceptable use
You agree not to use the Service to:
- upload or share content that is unlawful, infringing, defamatory, hateful, sexually explicit involving minors, or that incites violence;
- impersonate any person or entity, or falsely represent ownership of a recording;
- circumvent, disable or interfere with security-related features, rate limits or access controls;
- scrape, reverse-engineer or create derivative works from the Service except where expressly permitted by law;
- distribute malware, phishing links or automated spam;
- use the Service in a manner that violates any applicable law or regulation.
We reserve the right, but are not obliged, to review content and to suspend or terminate accounts that breach these Terms.
Contributor content and licence
You retain all ownership rights in content you submit to the Service ("Contributor Content"). By submitting Contributor Content you grant Malientu a non-exclusive, royalty-free, worldwide licence to host, store, preserve, reproduce, distribute, publicly display, migrate to new formats for preservation, caption and stream that Contributor Content for the purpose of operating the archive. The licence lasts until the content is removed at your request, but reasonable caching, backup and preservation-format copies may persist for a commercially reasonable period afterwards.
You represent that you own or have all necessary rights in the Contributor Content, that it does not infringe any third-party rights, and that its preservation on Malientu is authorised.

Malientu complies with the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, please send a notice to our designated agent:

Repeat infringers will have their accounts terminated in accordance with our internal strike policy.
Intellectual property of Malientu
The Service, including all software, design, text, graphics and trademarks (other than Contributor Content) is owned by or licensed to Malientu and is protected by intellectual property laws. Nothing in these Terms grants you any right to use the "Malientu" name or logos without prior written consent.
Fees
The Service is free. There are no paid tiers, no ads, no upsells and no revenue share with contributors.
Disclaimers
The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Malientu disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or free of harmful components.
Limitation of liability
To the fullest extent permitted by law, Malientu, its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our aggregate liability for any claim arising out of or relating to the Service will not exceed one hundred US dollars (US$100).
Indemnity
You agree to defend, indemnify and hold harmless Malientu from any claim or demand, including reasonable attorneys' fees, arising out of your Contributor Content, your use of the Service or your violation of these Terms.
Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Sections concerning contributor licence (for content still online), copyright, disclaimers, liability, governing law and arbitration survive termination.
Changes to the Service or Terms
We may modify the Service at any time. Material changes to these Terms will be announced at least 14 days in advance by email or in-product notice. Continuing to use the Service after the effective date of the new Terms constitutes acceptance of the changes.
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law provisions. The exclusive venue for any dispute that is not subject to arbitration shall be the state and federal courts located in Los Angeles County, California.
Arbitration and class-action waiver
Except for disputes that can be resolved in small-claims court, you and Malientu agree to resolve any dispute by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules. You and Malientu each waive any right to a jury trial or to participate in a class action. You may opt out of this arbitration clause within 30 days of creating your account by emailing legal@malientu.com.
Miscellaneous
These Terms, together with the Privacy Policy and Cookies Policy, constitute the entire agreement between you and Malientu. If any provision is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision will not be a waiver of that right or provision.
